These Terms of Service ("Terms") govern your use of the BrotherLink platform (the "Service"), operated by BPN Solutions LLC ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. Please read Section 12 (Indemnification) and Section 15 (Dispute Resolution and Arbitration) carefully — they affect your legal rights, including how claims between us are resolved.
The Service is available to initiated members and invited guests of participating fraternity chapters. By creating an account, you represent that you are at least 18 years old and that you are an initiated member of the chapter you are joining, or that you have been invited by a current member. False claims of membership may result in immediate account termination.

You must notify us immediately if you suspect unauthorized access to your account or that your chapter's access code has been disclosed outside the chapter.
When using the Service, you agree not to:
You retain ownership of the content you post on the Service. By posting content, you grant us a non-exclusive, royalty-free license to host, store, reproduce, and display that content within the Service to other members of your chapter organization, and to make the technical copies necessary to operate the Service (such as backups and image resizing). This license ends when you delete the content or your account, except for copies already distributed to other members and copies retained in backups until they expire.
If you use the share feature on a post, you are choosing to publish a preview of that post — its text, your name, and its image — at a link that anyone who receives it can open, including people without an account. Do not share a post outside the platform unless you are comfortable with that.
We reserve the right to remove content that violates these Terms or that we reasonably believe is harmful to the community. Chapter admins may also moderate content within their organization. We have no obligation to monitor content, and our right to remove it does not make us responsible for content we have not removed.
The Service includes a member directory populated from chapter records. By completing onboarding and claiming your directory entry, you consent to your name, graduation year, and profile information being visible to other verified members of your chapter. You may control what additional information is visible by editing your profile.
Access to the directory is granted to you personally, for personal and chapter-related purposes only. You agree that you will not:
These restrictions survive termination of your account. You acknowledge that a breach of this Section would cause harm for which money damages are an inadequate remedy, and that we and the affected chapter may seek injunctive relief in addition to any other available remedy.
The Service must not be used to plan, coordinate, encourage, document, celebrate, or conceal hazing, initiation abuse, coerced consumption of alcohol or any substance, sexual misconduct, threats, or any activity that endangers the health or safety of any person. This prohibition applies regardless of whether the underlying activity is described as voluntary, traditional, or consensual, and regardless of whether it is conducted on or off campus.
Violation of this Section is grounds for immediate termination without notice. We may preserve and disclose relevant content to the chapter's leadership, its national organization, the host institution, or law enforcement where we reasonably believe disclosure is necessary to prevent imminent harm to any person or as required by law. Nothing in our Privacy Policy's law-enforcement commitments limits our ability to act in an emergency involving a credible risk to someone's life or safety.
The Service provides tools to block members and to report content or conduct. Reporting through the Service is not a substitute for contacting emergency services, your institution, or law enforcement, and we are not a crisis, counseling, or emergency response provider.
We do not vet, screen, background-check, or verify members, employers, job listings, business opportunities, or other members' statements. Verification of chapter membership is performed by your chapter using its own records and access code; it is not an endorsement of any person or a representation about their character, conduct, or qualifications.
Events listed on the Service are created by chapters and their members, not by us. We do not organize, sponsor, host, fund, staff, supervise, or inspect any event, venue, or activity listed on the Service, and we make no representation about the safety, legality, or suitability of any of them. Your decision to attend an event, to meet another member, or to enter into any employment, business, financial, or personal arrangement arising from the Service is made at your own risk and is solely between you and the other parties involved.
You release BPN Solutions LLC from claims arising out of your interactions with other members or your attendance at any event listed on the Service, except to the extent caused by our own gross negligence or willful misconduct.
Each chapter organization controls who may access its community on the Service. BrotherLink is provided under an agreement with the chapter or its representatives, and your access depends on that agreement remaining in effect and on the chapter continuing to authorize you. A chapter admin may revoke your access at any time. Neither your institution nor any national fraternity organization is a party to these Terms unless it has separately agreed with us in writing. If a chapter's agreement with us ends, we may suspend that chapter's access and will handle the chapter's data as described in that agreement and in our Privacy Policy.
The Service, including its software, design, and the BrotherLink name and logo, is owned by BPN Solutions LLC and is protected by intellectual property law. These Terms grant you a limited, personal, revocable, non-transferable license to use the Service; they do not transfer any ownership to you. You may not copy, modify, reverse engineer, or create derivative works of the Service, or remove any proprietary notice from it.
If you send us feedback, suggestions, or feature ideas, you grant us a perpetual, royalty-free license to use them without obligation or compensation to you.
If you believe content on the Service infringes your copyright, send a notice to support@bpnsolutions.com that identifies the copyrighted work, identifies the allegedly infringing content and where it appears, provides your contact information, states that you have a good-faith belief the use is unauthorized, and states under penalty of perjury that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf. We will investigate and may remove the content and terminate repeat infringers.
We may suspend or terminate your account if you violate these Terms or if requested by a chapter admin. You may request account deletion at any time by contacting support or through the app. Upon termination:
Sections 4 (as to content already distributed), 5, 9, 12, 13, 14, 15, and 16 survive termination.
You agree to indemnify, defend, and hold harmless BPN Solutions LLC and its members, officers, employees, and contractors from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to: your content; your use of the Service; your breach of these Terms or of any law; your misuse or disclosure of another member's information or of the directory; your interactions with other members; or your attendance at or organization of any event listed on the Service. We may assume the exclusive defense and control of any matter subject to indemnification, at your expense, and you agree to cooperate with our defense. This Section does not apply to claims arising from our own gross negligence or willful misconduct.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure, that data will never be lost, or that defects will be corrected. We are not responsible for the accuracy of member-submitted content, job listings, event details, or directory information.
No advice or information obtained from us or through the Service creates any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this Section may not apply to you.
To the fullest extent permitted by law, BPN Solutions LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or business interruption, arising from your use of the Service, whether based in contract, tort, negligence, strict liability, or any other theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
Any claim arising out of or related to the Service or these Terms must be brought within one (1) year after the claim arose, or it is permanently barred, except where a longer period is required by law. These limitations apply even if a remedy fails of its essential purpose, and they do not limit liability that cannot be limited under applicable law.
Before starting any formal proceeding, you agree to contact us at support@bpnsolutions.com with a written description of your claim and to attempt in good faith to resolve it informally for at least thirty (30) days.
If the dispute is not resolved, you and BPN Solutions LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Indiana, rather than in court — except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property or to stop misuse of member data under Section 5.
Class action waiver. Claims must be brought in your individual capacity. You and we waive any right to bring or participate in a class, collective, consolidated, or representative action. If this waiver is found unenforceable as to a particular claim, that claim must proceed in court and is severed from arbitration.
Jury trial waiver. To the extent a dispute proceeds in court rather than arbitration, both parties waive any right to a trial by jury.
Your right to opt out. You may reject this Section 15 by emailing support@bpnsolutions.com with the subject line "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms. Opting out does not affect any other part of these Terms and will not affect your access to the Service.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to a change, stop using the Service and request account deletion.
The Service includes an optional AI-powered directory search assistant. When you use it, your search query and relevant directory profile information are sent to a third-party AI provider (Anthropic) for real-time processing under commercial terms that prohibit using the data to train AI models. By using this feature, you consent to this processing. AI output may be inaccurate or incomplete and should not be relied on as a statement of fact about any member. You are not required to use AI features to access the core functionality of the Service. If we add new AI-powered features, we will update these Terms and our Privacy Policy.
